The European Commission is currently reviewing the Directive on Copyright in the Digital Single Market (DSM Directive). In its contribution to the consultation, Bitkom advocates for an innovation-friendly and harmonised application of the existing regulations. Particular focus is placed on the provisions relating to text and data mining (TDM), which are of central importance for research, artificial intelligence, cyber security and data-driven innovation. Bitkom warns against further regulatory fragmentation and calls for greater legal certainty, better coordination with other EU frameworks such as the AI Act, and the practical implementation of existing rules without reopening the DSM Directive.
