From Bitkom’s perspective, the debate on artificial intelligence and copyright is, above all, a question of European competitiveness. In the paper, Bitkom analyses current political and legal developments at European and national level and assesses various reform proposals. The paper advocates retaining the existing TDM framework, proportionate transparency requirements and market-oriented, voluntary licensing. At the same time, Bitkom emphasises the need to create legal certainty for AI developers, start-ups and businesses in order to promote innovation in Europe and strengthen Europe’s position as a digital hub in the face of international competition.
