Purposes and legal basis of data processing
Below, we provide an overview of the type, scope, purposes and legal basis of data processing in connection with your application.
In this context, we generally process personal data that we receive from your application documents and from interviews with you. This may include contact details, all data related to your application (CV, references, qualifications, photo, etc.) and, if applicable, bank details (for reimbursement of travel expenses).
We process your data to carry out the application process and to check whether we can offer you the position you have applied for and hire you. The legal basis for this is Art. 88 para 1 GDPR in conjunction with Section 26 (1) sentence 1 BDSG. If the data is special categories of personal data (such as data relating to your health) that you provide to us yourself (e.g. information about severe disability), processing is carried out on the legal basis of Art. 9 para. 2 lit. b) GDPR in conjunction with Section 26 (3) BDSG.
If you sign an employment contract, we will store your data for the purpose of implementing the employment relationship. The legal basis for processing is Art. 88 para. 1 GDPR in conjunction with Section 26 (1) sentence 1 BDSG.
Further information on the processing of your data
Within Bitkom, only persons who need your data to perform the tasks assigned to them will have access to it. In addition, service providers or other persons who support us in performing our tasks may also have access to your data. These are service providers or persons in the following categories:
Service providers employed by us must meet special confidentiality requirements. They only have access to your data to the extent and for the period of time necessary to perform their tasks. We have concluded separate contracts for order processing in accordance with Art. 28 GDPR with service providers who are involved in order processing.
Unless there is a statutory retention period, your data will be deleted as soon as storage is no longer necessary or the legitimate interest in storage has expired. If no appointment is made, this will normally be the case no later than six months after completion of the application process.
In individual cases, individual data may be stored for a longer period (e.g. travel expense reports). The duration of storage is then based on the statutory retention obligations under the German Commercial Code or the German Fiscal Code (six or ten years) or the duration of legal proceedings and the subsequent limitation period.
If you are not hired but your application is still of interest to us, we will ask you if we may retain your application for future vacancies.
If you sign an employment contract, we will store your data for the duration of the employment relationship. In this case, you will receive further information about the processing of your data in the employment relationship as soon as you start working for us.
Rights of the data subject
You can request information about your personal data processed by us in accordance with Art. 15 GDPR.
If your data is not (or is no longer) correct, you can request the correction of your data in accordance with Art. 16 GDPR. If your data is incomplete, you can request that it be completed.
In accordance with Art. 17 GDPR, you have the right to request the erasure of your data.
In accordance with Art. 18 GDPR, you have the right to request the restriction of the processing of your data.
In accordance with Art. 21 GDPR, you have the right to object to the processing of your data on grounds relating to your particular situation. In the event of a justified objection, we will no longer process your data.
Objection to the processing of your data for direct marketing purposes
You have the right to object at any time to the processing of your data for direct marketing purposes. This also applies to profiling in connection with direct advertising. You can address your objection to us informally, preferably using datenschutz@bitkom.org.
You are entitled to lodge a complaint with a data protection supervisory authority if you do not agree with the processing of your data.
In accordance with Art. 20 GDPR, you have the right to receive personal data that you have provided to us in an electronic format.
You have the right to withdraw any consent you have given us to process your data at any time. The easiest way to withdraw your consent is to send an e-mail to datenschutz@bitkom.org. Withdrawal of consent does not affect the lawfulness of the processing of your data up to the time of withdrawal.
